Hire in the Philippines, without setting up there.

Hiring someone overseas yourself is allowed. The rules that come with them are the catch.

What the rules look at

The contract says contractor. The law looks at the work.

Set hours and daily direction

If you set their hours and direct their day, they can count as your employee.

Your equipment and systems

Supplying the laptop and logins is one of the signs that gets weighed.

Employer duties over there

Employers there cover SSS, PhilHealth, Pag-IBIG, tax and 13th month pay.

It has happened here

In 2024 the Fair Work Commission found that a contractor working from the Philippines for an Australian business was really an employee, and in 2025 it awarded her compensation.
